Terms of Use

1. Acceptance

By using PavingPretoria (the "Site") you agree to these terms. If you do not agree, do not use the Site.

2. What the Site is

The Site is a paving project management service. We accept project submissions from homeowners, match them with vetted paving contractors, and stay on as the homeowner's point of contact from first site visit to final walkthrough. We do not perform paving work ourselves.

3. No guarantee of contractor performance

We vet contractors on documented criteria (VAT registration, insurance, Google reviews, no complaints). However, we do not warrant the quality, timeliness, or pricing of any contractor's work. The actual paving contract is between you and the contractor. We are not a party to that contract.

4. No public price list

We do not publish price lists. Your quote is based on your specific project, given to you by the contractor at the site visit. We do not warrant any indicative pricing you may see on the Site.

5. No liability for contractor conduct

We are not liable for any loss, damage, injury, or dispute arising from your engagement with any contractor introduced through the Site. This includes but is not limited to:

  • Substandard work
  • Property damage during the job
  • Late or no-show by the contractor
  • Disputes over payment, scope, or warranty
  • Any third-party injury or claim

Our role is to try to resolve issues between you and the contractor. If resolution fails, your recourse is with the contractor directly.

6. Homeowner responsibilities

You are responsible for:

  • Verifying any contractor's credentials before signing a contract (we provide what we know, but you verify)
  • Getting your own written quote and contract
  • Inspecting completed work before final payment
  • Withholding retention if work is incomplete
  • Securing any required municipal permits, estate committee approvals, or HOA consents
  • Paying the contractor directly per your agreed schedule

7. No emergency or same-day service

The Site is for planned paving projects. For emergency repairs, contact a contractor directly.

8. How we are paid

After the contractor completes your project and you sign off, the contractor pays us a referral commission out of their margin. This is paid separately to your quote — your quote is the contractor's working price. We do not add a markup. We do not charge you a fee.

9. Intellectual property

All content on the Site is owned by Big42 Group (Pty) Ltd. You may not copy, scrape, republish, or resell it without written permission. You may link to it freely.

10. Limitation of liability

To the maximum extent permitted by law, Big42 Group (Pty) Ltd, its directors, employees, and contractors are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or from any engagement with a contractor introduced through the Site.

11. Indemnity

You indemnify Big42 Group (Pty) Ltd against any claim brought by a third party (including any contractor) arising from your use of the Site or your engagement with a contractor.

12. Suspension and termination

We may suspend or terminate your access to the Site at any time, for any reason, including but not limited to misuse, abusive behaviour toward contractors, or violation of these terms.

13. Governing law

These terms are governed by South African law. Any dispute will be resolved in the Magistrate's Court for Pretoria, or the High Court of South Africa (Gauteng Division, Pretoria) for matters exceeding the Magistrate's Court jurisdiction.

14. Changes to these terms

We may update these terms. Material changes will be flagged on the homepage for 30 days. Continued use after a change means you accept the new terms.
